「本当のゼロ」に向けて大きな声と力強い行動を韓国のICAAP10参加者声明

（解説）韓国の釜山で開かれている第10回アジア太平洋地域エイズ国際会議（ICAAP10）の会場BEXCOで、開会式直前の26日午後に、《韓国のHIV陽性者、マイノリティ、および支援者》を中心にした参加者らが発表した声明です。ICAAP10では、開会式の韓国保健大臣スピーチ中にアクティビストグループが抗議行動を行い、スピーチがかなり長い時間　にわたって（といっても15分ぐらいでしょうか）中断したり、2７日には会場のデモをめぐって警察と参加者の間でトラブルが発生し、逮捕者が出たりと、やや荒れ模様ですが、基本的にはICAAP10はHIV/エイズ関係のNGO/NPOやHIV陽性者団体にとっては大きな意見表明の機会です。組織委員会とアクティビストグループの関係も、対立と融和、協調をはかりつつ、より自由に意見が表明できる機会を確保するといった感じでしょうか。大きな枠組みとしての会議の存在は重要です。声明は抗議行動の背景にはどんな現状があり、どのような立場の人たちが何を求めて行動しているのかといったことを知るうえで、参考になるのではないかと思います。

　韓国のHIV陽性者、マイノリティ、および支援者はこのICAAPに参集した。現在の法律にはなお、HIV陽性の渡航者に対する規制が残っている。また、多国籍企業は独占的特許を有しており、HIV陽性者がそうした特許に守られている治療薬へのアクセスを得るのは困難になっている。私たちはゲイの人たちを感染源とみなすような韓国に対し、ICAAPが前向きな変化をもたらすのかどうか図りかねている。また、ICAAPの判断が「当事者」を歓迎されざる客と見なしているのではないかという疑いをぬぐえない。

　それでも私たちはここにいる。「多様な意見、結束した行動」をアジア太平洋諸国の人々と共有することがこうした問題を解決するための最初のステップだと考えている。さらにこの会議がHIV/エイズに関連する社会的課題を明確にし、私たちの気持ちを理解し共有する場になることを臨んでいる。

1.　私たちはFTAが特許を強化することを拒否し、延命効果の高い治療薬へのアクセスを確保することを要求する。
　アジア太平洋地域で治療へのアクセス、とりわけ治療薬に対するアクセスを確保しているHIV陽性者は30%にとどまっている。こうした特許薬の価格が高いことが重要な問題となっている。だが、アジア太平洋地域は自由貿易協定（FTA）のターゲットとなっている。とりわけ、インドとEUのFTA交渉は、世界のジェネリック薬の80%を占めるインドの薬を頼りにしている120カ国以上の患者の生命を脅かすことになる。

　OECD加盟国である韓国では、薬の価格の上昇と公共政策が受ける打撃のために、患者はより孤立することになるだろう。ハンナラ党は9月に韓国と米国のFTAを批准しようとしている。これはHIV陽性者を死に追い込むものだ。韓国と米国のFTAは韓国と米国の人々に害をなすだけではない。米国はTPPを米国のFTAの模範とみており、韓国と米国のFTA提案を標準にしようとしている。特許標準と投資条項は貧しい国に住む人たちの生命を脅かすことになるだろう。

2.　HIV陽性者を犯罪者として扱う差別的な法律の修正を
若者、女性、セックスワーカーとその客、移住者、少数者グループ、そしてMSMは、アジア太平洋地域ではHIV/エイズに対し、弱い立場にあると考えられている。彼らは簡単に治療や医療ケアへのアクセスを得ることができない。流行の元として烙印を押され、差別を受けている。社会的に購入が困難なほど治療薬の価格が上がれば、HIV感染の高いリスクにさらされている人たちと患者は社会のお荷物として扱われ、より差別的な状況に追い込まれるであろう。UNAIDSの差別ゼロ戦略はHIV/AIDSの拡大を予防するために不可欠である。

3. 現在の開発戦略はHIV/エイズの流行の構造的拡大要因となっている
アジア太平洋地域のHIV/エイズの流行は貧困が主要因であり、同時に貧困をもたらすものでもある。最も貧しい人たちがHIV/エイズに対し最も脆弱な立場に置かれている。HIV/エイズ問題は貧困対策の戦略抜きでは解決できない。多くの国で貧困対策が主要な開発戦略となっているのもこのためである。ところが、こうした政策が社会をよりHIV/エイズの流行に対し脆弱なものにしてもいる。開発が地域のコミュニティと社会の仕組みを破壊し、移住の原因にもなっている。このため、HIV/エイズの流行は急速かつ広範に拡大していくことになる。

私たちは「真の」ゼロを達成するために以下のことを要求する。
　UNAIDSは新規感染ゼロ、エイズ関連の死亡ゼロ、差別ゼロを目指す「ゼロ達成」戦略を採択した。持続可能な治療と人権の尊重がHIV/エイズの最も効果的な予防策である。したがって、国際社会と各国政府は特許強化の貿易政策が原因となっている死から目を背けてはならない。二国間貿易協定と政府開発援助（ODA）が公共セクターの私物化を促し、社会格差の拡大を助長している。このことがキーアフェクテッドグループ（最も大きな影響を受けている集団）を貧困と疾病、そして危険の増大という冷酷な悪循環に追い込んでいるのだ。

・すべてのHIV陽性者にHIV/エイズ治療薬を！
・ FTA交渉は人権よりも利益を優先させるな！
・若者に包括的なHIV/エイズ教育を！
・ HIV/陽性者を管理、差別するエイズ予防法を廃止し、差別反対法の制定を！
・セックスワーカーに対し、HIV/エイズを広げる元という烙印を押さず、労働権と健康権の保証を！
・移住者に対するHIV/エイズ強制検査をHIV陽性者への渡航規制を止めよ！
・ホモフォービア（同性愛者への差別）を助長せず、差別反対法の制定を！

Louder voices, Stronger actions for ‘Real Zero’

Korean PLs and minorities, and supportive people came to this ICAAP. Existing law still regulates travel of migrants living with HIV, and mualtinational cooperations possess exclusive patents, hence people living with HIV have difficulties in accessing such medicine. We could not certain whether ICAAP cause a positive change in Korea, in which gay people are regarded as a source of infection. Also, in each decision on ICAAP, 'the involveds' were unwelcome guests, so it was sufficient to make us skeptical.

Nevertheless we are here. We thought that sharing "diverse voices, unified actions" with the crowds from Asia-pacific nations is the first step to solve such problems. Moreover, we hope this place be revealing social issues related to HIV/AIDS, understanding and sharing our feelings.

1. We reject FTA compelling to strengthen the patents, to demand the readily access to life-saving medicines.

Only 30% of the positives can access treatments, particularly medicine, in Asia-pacific region. High price of such patent medicine cause the essential matter. Asia-pacific region, however, is considered as a target of FTA. Particularly, India-EU FTA, would threaten lifes of patients over 120 countries relying on generic medicines from India, which produces 80% of generic medicines of the whole world.

In OECD nations as Korea, patient will be more isolated, on account of increased prices and damaged public policies about medicines. The Hannara party attempts to ratify Kor-US FTA in September, which forces the death of the people living with HIV/AIDS. Kor-US FTA does not harm only peoples in Korea and US. US regards TPP as a prototype of US FTA, and tries to make the Kor-US FTA proposal to be the standard. Patent standards and investment clauses would threaten lives of people in poor countries.

2. Amend discriminating laws that treats people living with HIV/AIDS as criminals.

Youths, women, sex workers and buyer, migrants, minority groups, drug users and MSM are considered to be vulnerable to HIV/AIDS in asia-pacific region. They cannot easily access treatments and medical care services. They are stigmatized as the source of epidemic, so discriminated. If drug price rises to the extent that society cannot afford, the vulnerables and patients would be treated as social burden and be more discriminating situation. Zero-discrimination strategy of UNAIDS is essential to prevent spreading HIV/AIDS.

3. Present development strategies causes HIV/AIDS spread systemically.

Poverty is the main cause and effect of HIV/AIDS in asia-pacific region, and the poorest groups are most vulnerable to HIV/AIDS. HIV/AIDS issues cannot be solved without anti-poverty strategy. Hence anti-poverty strategies are main development strategy in many developing countries. However, these policies make society more vulnerable to HIV/AIDS. Developments destroy local communities and social structure, and cause migration. Hence HIV/AIDS spreads more rapidly and widely.

We demand the followings to accomplish "Real" Zero.

UNAIDS adopted "Getting to Zero" strategy, which means Zero new infection, Zero AIDS-related deaths, Zero discrimination. Sustainable treatment and human rights is the most effective way of HIV/AIDS prevention. Thus, international society and domestic governments should not avoid the deaths caused by trade policies that strengthen patents. Bilateral trade agreement and ODA privatize the public sector and worsen social inequalities. This put key-affected groups into vicious circle of poverty and disease and greater danger.

▶Provide HIV/AIDS drugs to all people living with HIV/AIDS!

▶Stop FTA putting profits before health rights!

▶Provide comprehensive education on HIV/AIDS for youth!

▶Repeal AIDS prevention act which controls and discriminates PLWHA, and adopt anti-discrimination law!

▶Do not stigmatize sex workers as a source of spreading HIV/AIDS, and guarantee their labor rights and health rights!

▶Stop mendatory HIV/AIDS tests on migrants, and stop immigration control on PLWHA!

▶Stop promoting homophobia, and adopt anti-discrimination law!
